This license is for your protection as a Contributor as well 33 as the protection of Project Owner; it does not change your rights to use your own 34 Contributions for any other purpose. 35 36 You accept and agree to the following terms and conditions for Your present and future 37 Contributions submitted to Project Owner. Except for the license granted herein to 38 Project Owner and recipients of software distributed by Project Owner, You reserve 39 all right, title, and interest in and to Your Contributions. 40 41 ### Definitions 42 43 "You" (or "Your") shall mean the copyright owner or legal entity authorized by 44 the copyright owner that is making this Agreement with Project Owner. For legal 45 entities, the entity making a Contribution and all other entities that control, are 46 controlled by, or are under common control with that entity are considered to be a single 47 Contributor. For the purposes of this definition, "control" means (i) the power, direct 48 or indirect, to cause the direction or management of such entity, whether by contract 49 or otherwise, or (ii) ownership of fifty percent (50%) or more of the outstanding 50 shares, or (iii) beneficial ownership of such entity. 51 52 "Contribution" shall mean any original work of authorship, including any modifications 53 or additions to an existing work, that is intentionally submitted by You to Project 54 Owner for inclusion in, or documentation of, any of the products owned or managed by 55 Project Owner (the "Work"). For the purposes of this definition, "submitted" means any 56 form of electronic, verbal, or written communication sent to Project Owner or its 57 representatives, including but not limited to communication on electronic mailing lists, 58 source code control systems, and issue tracking systems that are managed by, or on 59 behalf of, Project Owner for the purpose of discussing and improving the Work, but 60 excluding communication that is conspicuously marked or otherwise designated in writing 61 by You as "Not a Contribution." 62 63 ### Grant of Copyright License 64 65 Subject to the terms and conditions of this Agreement, You hereby grant to Project 66 Owner and to recipients of software distributed by Project Owner a perpetual, 67 worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license 68 to reproduce, prepare derivative works of, publicly display, publicly perform, 69 sublicense, and distribute Your Contributions and such derivative works. 70 71 ### Grant of Patent License 72 73 Subject to the terms and conditions of this Agreement, You hereby grant to Project 74 Owner and to recipients of software distributed by Project Owner a perpetual, 75 worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in 76 this section) patent license to make, have made, use, offer to sell, sell, import, 77 and otherwise transfer the Work, where such license applies only to those patent 78 claims licensable by You that are necessarily infringed by Your Contribution(s) 79 alone or by combination of Your Contribution(s) with the Work to which such 80 Contribution(s) was submitted. If any entity institutes patent litigation against 81 You or any other entity (including a cross-claim or counterclaim in a lawsuit) 82 alleging that your Contribution, or the Work to which you have contributed, 83 constitutes direct or contributory patent infringement, then any patent licenses 84 granted to that entity under this Agreement for that Contribution or Work shall 85 terminate as of the date such litigation is filed. 86 87 ### Miscellaneous 88 89 1. You represent that you are legally entitled to grant the above license. If your 90 employer(s) has rights to intellectual property that you create that includes 91 your Contributions, you represent that you have received permission to make 92 Contributions on behalf of that employer, that your employer has waived such 93 rights for your Contributions to Project Owner, or that your employer has 94 executed a separate Corporate CLA with Project Owner. 95 96 2. You represent that each of Your Contributions is Your original creation 97 (see section 4 for submissions on behalf of others). You represent that Your 98 Contribution submissions include complete details of any third-party license 99 or other restriction (including, but not limited to, related patents and trademarks) 100 of which you are personally aware and which are associated with any part of Your 101 Contributions. 102 103 3. You are not expected to provide support for Your Contributions, except to 104 the extent You desire to provide support. You may provide support for free, 105 for a fee, or not at all. Unless required by applicable law or agreed to in 106 writing, You provide Your Contributions on an "AS IS" BASIS, WITHOUT WARRANTIES 107 OR CONDITIONS OF ANY KIND, either express or implied, including, without 108 limitation, any warranties or conditions of TITLE, NON- INFRINGEMENT, 109 MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. 110 111 4. Should You wish to submit work that is not Your original creation, You may 112 submit it to Project Owner separately from any Contribution, identifying the 113 complete details of its source and of any license or other restriction (including, 114 but not limited to, related patents, trademarks, and license agreements) of 115 which you are personally aware, and conspicuously marking the work as 116 "Submitted on behalf of a third-party: [named here]". 117 118 5.
